Title
National Guard, active military service, compensation for injury or death, coverage under State Employees Injury Compensation Fund, Sec.36-29A-1 am'd; Sec. 31-2-85 repealed.
Description

Under existing law, members of the Alabama National Guard or Alabama State Defense Force, who as a direct result of active military state service are wounded, injured, disabled, or killed, are entitled to receive medical care and other compensation for injury, disability, or death

Payment of any claim is paid through appropriations to the State Military Department. State employees who are injured or suffer death on the job are covered under the State Employees Injury Compensation Program operated by the Division of Risk Management of the State Finance Department

This bill would provide that members of the Alabama National Guard or Alabama State Defense Force who are injured or suffer death as a direct result of active military service would be covered under the State Employees Injury Compensation Program in the same manner as state employees and the existing law would be repealed. This bill also provides authority for the Military Department to pay medical expenses for members of the National Guard or Alabama State Defense Force who become ill during or have minor injuries as a direct result of active military service for the state not covered by the State Employees Injury Compensation Program

Relating to the State Military Department and members of the Alabama National Guard; to amend Section 36-29A-1 of the Code of Alabama 1975, relating to the State Employees Injury Compensation Program, to provide that members of the Alabama National Guard and Alabama State Defense Force who suffer personal injury as a direct result of active military service for the state would be covered by the program; to authorize the Military Department to pay medical expenses for members of the National Guard or Alabama State Defense Force who become ill during active military service or have minor injuries as a direct result of active military service for the state not covered by the State Employees Injury Compensation Program; and to repeal Section 31-2-85 of the Code of Alabama 1975, providing compensation for injury, disability, or death of a member of the Alabama National Guard or Alabama State Defense Force.
