The bill adds a new section to clarify the Board of Dental Examiners' rulemaking over anti-trust issues and allows health-priority rules that may appear anti-competitive, with immunity from related liability.
It adds Section 34-9-43.2 to authorize the Board to create rules governing the practice of dentistry, dental hygiene, and expanded duty dental assisting in relation to state and federal anti-trust laws, and to permit rules that prioritize patient health, safety, and welfare even if they seem anti-competitive. It provides immunization from liability under anti-trust laws for the board, its members, employees, and agents when adopting such rules. It allows these rules to define or regulate practice to prioritize health and safety, while not conflicting with existing statutes that define the practice.
