Title
Firearms, possession of does not constitute disorderly conduct, possession of in a vehicle or on certain property authorized under certain conditions, exception, Secs. 13A-11-7, 13A-11-73, 13A-11-74, 13A-11-75 am'd.
Description
<p class="bill_description"> This bill would provide that lawfully carrying a firearm under certain conditions does not, in and of itself, constitute the crime of disorderly conduct</p><p class="bill_description"> This bill would authorize a person to carry a pistol without a license on property under his or her control, in his or her vehicle, in his or her place of abode, in his or her fixed place of business, and on the property of another or a vehicle owned by another, with consent</p><p class="bill_description"> The bill would prohibit a person under 18 years of age from possessing a pistol on his or her person or in any vehicle, except on land under his or her control, in his or her abode, or in his or her place of business</p><p class="bill_description"> Amendment 621 of the Constitution of Alabama of 1901, now appearing as Section 111.05 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, prohibits a general law whose purpose or effect would be to require a new or increased expenditure of local funds from becoming effective with regard to a local governmental entity without enactment by a 2/3 vote unless: it comes within one of a number of specified exceptions; it is approved by the affected entity; or the Legislature appropriates funds, or provides a local source of revenue, to the entity for the purpose</p><p class="bill_description"> The purpose or effect of this bill would be to require a new or increased expenditure of local funds within the meaning of the amendment. However, the bill does not require approval of a local governmental entity or enactment by a 2/3 vote to become effective because it comes within one of the specified exceptions contained in the amendment</p><p class="bill_entitled_an_act"> To amend Sections 13A-11-7, 13A-11-73, 13A-11-74, and 13A-11-75, Code of Alabama 1975, to provide that lawfully carrying a firearm does not, in and of itself, constitute disorderly conduct; to authorize certain persons to carry a pistol in his or her vehicle or on certain property without a concealed pistol permit; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Amendment 621 of the Constitution of Alabama of 1901, now appearing as Section 111.05 of the Official Recompilation of the Constitution of Alabama of 1901, as amended. </p>
