Description

Under existing law, when a requirement exists that a written certificate or other document be filed with the Department of Revenue, the Commissioner of Revenue may accept a filing by electronic means in lieu of a filing using a paper written certificate

This bill would authorize the Commissioner of Revenue to waive the notarization requirements associated with the filings

Under existing law, designated agents of the state, which include judges of probate, commissioners of licenses, directors of revenue, and certain other county officials, may retain a commission for the processing of motor vehicle and manufactured home title applications

This bill would provide that when the Department of Revenue processes a motor vehicle or manufactured home title application, and the application is not processed by a designated agent, the department may collect the $1.50 commission authorized to be collected by the designated agent

Under existing law, the Department of Revenue may issue a replacement certificate of title when the original certificate of title is lost, stolen, mutilated, or destroyed or becomes illegible. Also under existing law, the department may not issue a new certificate of title to a transferee upon application made on a replacement certificate of title until 15 calendar days after the issuance date of the surrendered replacement title

This bill would provide that, upon application made on a replacement certificate, a new certificate of title to a transferee may be issued without a 15-day hold if the title information can be verified through the National Motor Vehicle Title Information System

Relating to certificates of title; to amend Sections 32-8-3, 32-8-7, 32-8-35, 32-8-43, 32-20-3, 32-20-5, 32-20-23, and 32-20-29, Code of Alabama 1975, to authorize the Commissioner of Revenue to waive certain notarization requirements; to authorize the Department of Revenue to collect certain certificate of title application commissions; and to provide further for the issuance of new certificates of title under certain conditions.
