The county commission is authorized to levy a per-ton privilege or excise tax on biosolids composed of human wastewater disposed in county landfills, with the rate set by the commission. Landfill operators collect the tax from the deliverers and must be paid by the 15th day of the month after delivery; if the tax is not paid, the operator is liable. Tax proceeds are used exclusively for the county's solid waste program, and Jefferson County is exempt from paying the tax. The act becomes effective on the first day of the third month after passage and governor approval.
