SB105 extends civil liability immunity to FEMA-certified community emergency response teams and other specified emergency responders who provide care at the scene, with related immunities and conditions, effective October 1, 2024.
It adds CERT members to the protected group for giving first aid or emergency care at accident scenes, shielding them from civil damages for acts or omissions and for not arranging further treatment. It also creates or expands immunity related to AED use, helicopter downwash, mine rescue operations, and certain supervising professionals when acting in good faith and under established procedures, with some exceptions. Immunity generally applies to care given without charge or within a reasonable, prudent standard, and the act specifies a 90-day window after emergency declarations for some immunities.
