SB242 would let counties and municipalities create Innovation Districts as public corporations to drive economic development by directing public revenues to support designated enterprises.
It authorizes the incorporation of an innovation district as a public corporation by local governments to undertake projects, acquire property, and use public revenues to support qualified enterprises designated by the Department of Commerce. It sets the creation and dissolution procedures and establishes a board of directors with terms up to six years, with the majority appointed by the authorizing subdivisions and a possible non-voting director from the Alabama Innovation Corporation. It gives districts broad powers, including land acquisition, leasing, contracting, and issuing financial obligations with up to 45-year terms, secured by district assets and potentially supported by special public revenues. It also provides exemptions from certain taxes, fees, competitive bidding, and state oversight, requires annual audits, and requires districts to operate as nonprofit corporations with liability protections and open meetings compliance.
