SB194 lets Alabama agriculture authorities terminate or relocate easements on authority-owned property using eminent domain, effective October 1, 2025, with an exemption for electric utility easements.
If enacted, agriculture authorities can terminate or move easements on their own property using the state's eminent domain power, following the same process and conditions as the state. An easement held by electric utilities on that property would not be affected by this change. The bill also broadens the authorities' general powers (such as acquiring property, entering contracts, financing projects, and forming subsidiaries) to support their goals for agriculture-related development.
