HB159 would allow circuit clerks to participate in both the supernumerary circuit clerk program and the Employees' Retirement System if their qualifying years of service are separate.
Under current law, circuit clerks cannot participate in both programs based on the same service. HB159 would allow dual participation for circuit clerks who independently qualify for both programs based on separate years of service. The act would take effect on July 1, 2026.
