SB107 would expand regulation of funeral services in Alabama by authorizing an administrative fee, increasing licensure and registration fees, and adding stronger preneed reporting, registration, and background-check requirements for preneed sales agents and affiliated funeral directors, plus a potential statewide preneed database.
It authorizes the Alabama Board of Funeral Services to charge funeral establishments an administrative fee of up to $30 per funeral, beginning June 1, 2026, with funds deposited into the ABFS Fund. It increases initial and renewal fees for a certificate of authority and for branch registrations, and increases initial and renewal fees for preneed sales agents. It requires certificate holders to file annual statements of preneed activities and annual reports on preneed contracts, with the board allowed to require additional reports and to waive certain reporting under specified conditions. It adds registration and background-check requirements for preneed sales agents (including fingerprints and state/federal checks, with applicant costs) and makes certificate holders responsible for their agents’ conduct, while enabling a possible statewide preneed database with an opt-out option.
