SB131 tightens the developer-to-immediate-family transfer exemption from subdivision regulations to 24 months and updates the code language.
It amends Section 11-24-2 to cap the exemption for transfers of land from a developer to an immediate family member at 24 months from the transfer date. If the land is sold or transferred to someone outside the immediate family within that 24-month window, the land becomes subject to the county's subdivision regulations, including plat submission, review, and permitting. The bill also makes nonsubstantive, technical revisions to update the code language to current style and sets an effective date of October 1, 2026.
