SB239 lets temporary emergency custody orders under the Uniform Child Custody Jurisdiction Enforcement Act become final in Alabama under certain conditions.
It amends Alabama Code 30-3B-204 to allow emergency custody determinations made under UCCJEA to be finalized without a new state custody proceeding, if specified conditions are met. A temporary order becomes final after six months with no further proceeding in any state, or if Alabama becomes the child’s home state and no proceeding has been started elsewhere. The court must include a time period for obtaining an order from the other state, and the temporary order remains in effect until that order is issued or the period expires. The courts in Alabama and in other states must communicate to resolve the emergency and set the duration of the temporary order.
