SB260 updates Alabama's Self-Service Storage Facilities Act to allow electronic rental agreements, update post-termination disposal rules for occupants' property, and replace newspaper notices with commercially reasonable methods.
Permits rental agreements for self-service storage facilities to be delivered and executed electronically, and allows acceptance of the rental agreement if an occupant uses the space for at least 30 days after delivery—even without a signed lease. Authorizes operators to include provisions in rental agreements notifying occupants of the right to dispose of personal property left at the facility after the rental ends, and allows reasonable post-termination restrictions and disposal of remaining property after a set removal period. Removes the requirement to publish sale notices in a newspaper and instead requires notices to be published in any commercially reasonable manner, including online or other venues likely to attract bidders. Clarifies lien and sale procedures, including 20 days' notice of default, 7 days' advertisement, and the ability to sell or dispose of property to satisfy the lien, with liability limits for operators and lienholders and definitions for key terms; adds rules for notices to occupants via verified mail or electronic mail.
