SB273 would make a second or subsequent offense of stalking in the second degree a Class C felony, increasing penalties for repeat stalkers, with the change taking effect October 1, 2026.
Under current law, stalking in the second degree is a Class B misdemeanor. SB273 keeps the first offense as a Class B misdemeanor, but any second or later violation would be charged as a Class C felony. The offense still requires following, harassing, or communicating with a targeted person or their close contacts, causing material harm or reasonable fear that employment is threatened, and prior notice to cease. The bill amends Section 13A-6-90.1 and becomes effective on October 1, 2026.
