SB41 changes how assets are handled when an elder is abused or killed, affecting inheritance, joint ownership, and life insurance.
It amends Section 43-8-253 to bar survivors who abuse or kill the elder from receiving benefits under the will or related documents, with the estate passing as if the killer predeceased. It also ends survivorship rights in joint ownership (like joint accounts and co-owned property) for the killer, so the decedent’s share passes to other heirs. It disqualifies beneficiaries of life insurance, bonds, or other contracts who abuse or kill the elder, making those payments payable as if the killer predeceased. It requires courts to determine felonious and intentional killings by preponderance of evidence if there is no conviction and to record final convictions in county probate offices, with an effective date of October 1, 2026.
