Criminal defendants, youthful offender status, persons charged with a crime involving intentional serious physical injury or death not eligible, Sec. 15-19-1 am'd.
Description

Under existing law, a person charged with a crime committed during his or her minority which involves moral turpitude or is a felony is required to be investigated and examined by the court to determine if he or she should be granted youthful offender status

This bill would provide that a person would not be eligible to be granted youthful offender status if the crime the person is charged with contains as an element of the charge that the defendant intentionally inflicted serious physical injury or intentionally killed the victim in the commission of the crime

To amend Section 15-19-1 of the Code of Alabama 1975, relating to a person charged with crimes committed in their minority who are eligible to be considered by the court for youthful offender status, to provide that a person charged with a crime which alleges that the defendant intentionally inflicted serious physical injury or intentionally killed the victim of the crime would not be eligible for youthful offender status.
