HB492 repeals Act 720 (1978), which created and funded the 25th Judicial Circuit Public Defender’s Office, effectively ending that office and its funding mechanism.
It repeals Act 720 of the 1978 Regular Session, which created the Public Defender’s Office for the 25th Judicial Circuit (Marion and Winston Counties) and set up its operation and financing. It removes the funding structure that used added court costs and the Public Defender’s Fund to pay for indigent defense in that circuit. There is no replacement plan in this bill; it simply ends the office and its financing. The repeal becomes effective on the first day of the third month after it passes and is approved by the Governor, or otherwise becoming law.
