SB511 amends Jefferson County's solicitor's fee distribution in Birmingham and Bessemer divisions, setting aside a portion for clerks' funds and minimum amounts tied to the Fair Trial Tax Fund.
In juvenile, traffic, criminal, and quasi-criminal cases in the Birmingham and Bessemer divisions, a solicitor's fee is assessed. Three dollars per case is paid to the appropriate clerk's fund (circuit clerk's fund or municipal court clerk's fund), and the remainder goes to the Solicitor's Fund or District Attorney's Fund for the division. The solicitor's fee must be at least as large as the docket fees or court costs allocated to the Fair Trial Tax Fund for guilty adjudications, and in no case can it be less than the Fair Trial Tax Fund docket fee. The act takes effect on the first day of the third month after it passes and becomes law.
