Motor vehicles, persons involved in accidents causing serious bodily injury or death required to submit to blood tests, law enforcement officers authorized to take reasonable steps to obtain sample, immunity, Sec. 32-5-200 am'd
Description

Under existing law, a person involved in an accident that results in death or a serious physical injury to any person is deemed to have given consent to a blood test to determine alcohol content or the presence of certain substances. The failure to submit to a test will result in the suspension of the person's driver's license for a period of two years

This bill would require all persons involved in an accident that results in death or a serious physical injury to submit to a blood test upon probable cause and would allow a law enforcement officer to take reasonable steps to obtain the blood sample

This bill would also provide certain health care providers immunity from civil or criminal liability related to the administration of a blood test at the direction of law enforcement

To amend Section 32-5-200, Code of Alabama 1975, to require all persons involved in an accident that results in death or a serious physical injury to submit to a blood test upon probable cause; to authorize law enforcement officers to take reasonable steps to obtain a blood sample; and to provide immunity to certain health care providers administering blood tests at the direction of law enforcement.
