Regular Session 2012
Title
Motor vehicles, abandoned, includes an order to remove a motor vehicle by law enforcement officers if the driver is arrested or injured, or otherwise needs moving, Secs. 32-13-1, 32-13-2 am'd
Description

Under existing law, a law enforcement officer may have a motor vehicle towed if the motor vehicle has been unattended on a public street, road, or highway for seven days or more. Under this law, the towing agent or wrecker service has a lien for the towing charge and storage

This bill would further define an abandoned motor vehicle and would specify that a law enforcement officer may have a motor vehicle towed if the driver of the motor vehicle has been arrested or injured or the motor vehicle needs to otherwise be removed from a public street or highway, or if the vehicle is subject to an impoundment order of law enforcement officers for outstanding traffic or parking violations

To amend Sections 32-13-1 and 32-13-2 of the Code of Alabama 1975, relating to abandoned motor vehicles, to further define an abandoned motor vehicle and to specify when a law enforcement officer may have a motor vehicle towed if the driver has been arrested or is injured or the motor vehicle otherwise needs to be removed from a public street or highway.
