- Description
Under existing law, subject to certain limitations, the state, any municipality or county, and other entities organized by or under the control of the state, municipalities, and counties are authorized to exercise the power of eminent domain to condemn property.
This bill would prohibit the state, municipalities and counties, and entities organized thereunder, from using the power of eminent domain to acquire mortgages or deeds of trust.
