Bill Summary
Under existing law, the punishment for driving under the influence includes fines and imprisonment. The law requires that $100 of the fine, minus administrative costs, be deposited in the Alabama Head and Spinal Cord Injury Trust Fund.
However, a court may waive the fine.
This bill would make the imposition of the $100 fine allocated to the Alabama Head and Spinal Cord Injury Trust Fund mandatory so that it may not be waived by a court.
Relating to driving under the influence; to amend Section 32-5A-191, Code of Alabama 1975; to make the $100 fine allocated to the Alabama Head and Spinal Cord Injury Trust Fund that is imposed for driving under the influence a mandatory fine that may not be waived by a court.
