- Description
Under existing law, the Public Service Commission (PSC) operates a database of residential telephone subscribers who object to receiving telephone solicitations. The PSC is authorized to charge a fee every two years for inclusion on the list. A person or entity is prohibited from making a telephone solicitation to any residential subscriber on the list. In addition, a person or entity making a telephone solicitation to a residential subscriber is required to identify himself or herself and is prohibited from circumventing caller identification. The PSC is authorized to assess a civil penalty up to $2,000 for violations and under certain conditions a person may bring a civil action for damages up to $2,000.
This bill would provide that the Do Not Call Law would also apply to commercial telephone subscribers and to cellular telephone subscribers.
The bill would also increase the civil penalty and the amount of damages that may be recovered to $5,000 in both cases.
