Description

Under existing law, the mayor of municipalities formed under Chapter 43D, Title 11 of the Code of Alabama 1975, manages the municipal public utilities

To amend Section 11-43D-14, Code of Alabama 1975, relating to certain Class 5 municipalities; to delete the provision for the management of public utilities by the mayor.

Under existing law, the mayor of municipalities formed under Chapter 43D, Title 11 of the Code of Alabama 1975, manages the municipal public utilities

This bill would remove the management of public utilities from the mayor

To amend Section 11-43D-14, Code of Alabama 1975, relating to certain Class 5 municipalities; to delete the provision for the management of public utilities by the mayor.

Section 1

Section 11-43D-14 of the Code of Alabama 1975, is amended to read as follows:

§11-43D-14.

The mayor shall be the chief executive officer, and shall have general supervision and control of all other officers, employees, and affairs of the city, which shall specifically not include the management of the public utilities, either owned and operated by the city or operated by private corporations under contracts with the city. The general law applicable to mayor-council municipalities notwithstanding, and except as provided above, the mayor shall have the power to appoint all officers and employees of the city subject to the rules and regulations of any civil service or merit system that may be applicable to said the city. The mayor may remove any person appointed by him or her subject to the rules and regulations of any civil service or merit system that may be applicable to said the city."

Section 2

This act shall become effective upon the commencement of the next term of office of the city council in any municipality formed under Chapter 43D, Title 11 of the Code of Alabama 1975.
