Title
Pharmacy Bd., appeals of decisions to circuit court, venue in county where bond is located, Sec. 34-23-94 am'd.
Description

Under existing law, appeals from orders of the State Board of Pharmacy may be filed in the circuit court where the party aggrieved resides.

Appeals are otherwise governed by the judicial review provisions of the Alabama Administrative Procedure Act (AAPA). Appeals under the AAPA may be filed in the Circuit Court of Montgomery County or in the circuit court of the county in which the agency maintains its headquarters, or unless otherwise specifically provided by statute, in the circuit court of the county where a party resides.

This bill would specify that an appeal from orders of the State Board of Pharmacy would be required to be filed in the county where the board maintains its headquarters.

To amend Section 34-23-94 of the Code of Alabama 1975, relating to judicial review of orders of the State Board of Pharmacy; to specify that appeals of orders of the board would be filed in the county where the board maintains its headquarters.
