Title
Firearms, offenses against public order, concealed pistols, concealed carry permit, constitutional carry, pistol permits, Secs. 9-11-304, 13A-11-52, 13A-11-73, 13A-11-74 repealed; Secs. 13A-11-7, 13A-11-50, 13A-11-55, 13A-11-61.2, 13A-11-62, 13A-11-71, 13A-11-85, 13A-11-90 am'd.
Description
<p class="bill_description"> Under existing law, no person is authorized
to carry a concealed weapon or an unsecured firearm
in his or her vehicle unless the person has a valid
Alabama permit to carry a concealed weapon</p><p class="bill_description">
Also under existing law, when a person
commits a crime of violence, the possession of a
pistol without a permit is prima facie evidence of
the intent to commit the crime</p><p class="bill_description">
This bill would repeal certain restrictions
on the carrying or possession of a firearm on
certain property or in a motor vehicle by persons
with or without a concealed pistol permit</p><p class="bill_description">
The bill would revise certain restrictions
on the carrying or possession of firearms at
certain locations, and would revise the definition
of a courthouse annex, one of the locations in
which carrying or possession of a firearm is
prohibited</p><p class="bill_description">
This bill would revise the presumption that
a person carrying a pistol without a pistol permit
is prima facie evidence of intent to commit a crime
of violence</p><p class="bill_description">
This bill would eliminate the requirement
for a person to obtain a concealed carry permit in
order to lawfully carry a pistol</p><p class="bill_description">
This bill would also make nonsubstantive,
technical revisions to update the existing code
language to current style</p><p class="bill_description">
Amendment 621 of the Constitution of Alabama
of 1901, as amended by Amendment 890, now appearing
as Section 111.05 of the Official Recompilation of
the Constitution of Alabama of 1901, prohibits a
general law whose purpose or effect would be to
require a new or increased expenditure of local
funds from becoming effective with regard to a
local governmental entity without enactment by a
2/3 vote unless: it comes within one of a number of
specified exceptions; it is approved by the
affected entity; or the Legislature appropriates
funds, or provides a local source of revenue, to
the entity for the purpose</p><p class="bill_description">
The purpose or effect of this bill would be
to require a new or increased expenditure of local
funds within the meaning of the amendment. However,
the bill does not require approval of a local
governmental entity or enactment by a 2/3 vote to
become effective because it comes within one of the
specified exceptions contained in the amendment</p><p class="bill_entitled_an_act"> Relating to firearms; to amend Sections 13A-11-7,
13A-11-50, 13A-11-55, 13A-11-61.2, 13A-11-62, 13A-11-71,
13A-11-85, and 13A-11-90, Code of Alabama 1975, to delete
certain language regarding the carrying of a visible pistol;
to delete certain language regarding the carrying of a
concealed pistol; to revise certain restrictions on the
carrying or possession of firearms at certain locations; to
eliminate the requirement for a person to obtain a concealed
carry permit to lawfully carry a pistol; to revise language
regarding an employee storing a firearm in the employee's
vehicle; to make nonsubstantive, technical revisions to update
the existing code language to current style; to repeal
Sections 9-11-304, 13A-11-52, 13A-11-73, and 13A-11-74, Code
of Alabama 1975, relating to the carrying or possession of a
firearm or pistol, to repeal certain restrictions on the
carrying or possession of a firearm on certain property or in
a motor vehicle; and in connection therewith would have as its
purpose or effect the requirement of a new or increased
expenditure of local funds within the meaning of Amendment 621
of the Constitution of Alabama of 1901, as amended by
Amendment 890, now appearing as Section 111.05 of the Official
Recompilation of the Constitution of Alabama of 1901.
