SB63 would shield county commissions from liability in lawsuits over how public funds are spent when a local law lets a single public official decide how to spend the funds.
If enacted, the bill states that a county commission cannot be liable or a party to lawsuits challenging the expenditure or use of public funds when local law grants spending discretion to one public official. For such suits, no damages or litigation costs may be recovered from county funds. The act would take effect on October 1, 2024.
