HB162 would bar state and local governments and their law enforcement from transporting homeless people to another city or county in Alabama unless allowed by law, court order, or the homeless person’s consent, and it imposes penalties for violations.
The bill prohibits the state, any political subdivision, and their law enforcement officers, agents, or employees from transporting a homeless person to a different city or county within Alabama unless authorized by law, a court order, or the homeless person (or their agent) approves. It allows an exception if there is written consent from an entity in the destination area that agrees to accept the individuals and actually does accept them. Violations would be classified as Class A misdemeanors, with a separate offense counted for each person transported. The act takes effect on October 1, 2025.
