HB280 lets counties and public colleges sue to abate public nuisances and recover costs from organizers of improperly permitted events.
It extends the authority to file nuisance abatement actions to counties and public institutions of higher education. If the nuisance comes from an event that wasn't properly permitted, the court can order organizers to reimburse the local government for abatement costs (like public safety, traffic control, and sanitation) and must award court costs and reasonable attorney fees to the prevailing plaintiff. Non-participating property owners, managers, or landlords cannot be held liable. The act takes effect immediately.
