HB295 updates Alabama's military justice rules by expanding who can administer non-judicial punishments, what punishments may be used, and how appeals and reductions work, with new rules taking effect October 1, 2025
It allows certain commanding officers and high ranking officials to impose non-judicial punishments for minor offenses without court-martial, and permits delegation to a principal assistant who is a member of the Alabama National Guard. It lists a range of punishments (admonition, reprimand, loss of privileges, pay forfeiture, pay grade reductions, extra duties, and restrictions) with specific time limits, and extends some punishment authority to officers and enlisted within defined rank groups. It establishes rules for combining punishments, appeals within 30 days, and rights to counsel, and preserves the option to go to court-martial for serious crimes; it also expands special court-martial powers regarding rank reductions. Finally, it sets an effective date of October 1, 2025.
