HB537 would let a pretrial detention hearing for certain Aniah's Law offenses count as the defendant's preliminary hearing.
It amends Section 15-11-1 to let a pretrial detention hearing held for offenses listed under Aniah's Law satisfy the defendant's right to a pretrial hearing. The pretrial detention hearing held under Section 15-13-3 counts as the required pretrial hearing for those offenses. The existing rule that a felony defendant has an absolute right to a preliminary hearing within 30 days remains, but for Aniah's Law offenses this detention hearing can satisfy that right. The bill also keeps that failure to appear or being out of state does not delay indictment, and it becomes effective October 1, 2025.
