SB231 would bring certain privately owned sewer and wastewater systems under the regulatory authority of the Alabama Public Service Commission, regardless of how the wastewater is disposed of.
It creates size-based categories for privately owned wastewater systems and places PSC oversight on them. Cluster systems (design flow 15,000 GPD) would be regulated, with designs certified by licensed engineers and adherence to ADPH or ADEMs design and permits. The bill allows PSC to approve customer rates and to certify the financial viability of the wastewater management entity; the act becomes effective October 1, 2025.
