Senate Judiciary Hearing
Room 325 at 08:30:00

HB282 changes when Board of Pardons and Paroles members begin their terms and how they are appointed, moving the start date from July 1 to March 1, with related term and transition rules, and adds an immediate CP&C consequence when a defendant is later convicted and imprisoned.
The bill amends Section 15-22-20 to shift board member commencements from July 1 to March 1 and establishes six-year terms for new members beginning March 1 (with a transition for members serving on Oct 1, 2026). It outlines the appointment process: vacancies filled by the Governor from five nominees chosen by a nominating committee, with Senate confirmation rules and interim appointment provisions; the Governor designates the chair. It also adds a separate provision that if a defendant supervised in community punishment and corrections is later convicted and sentenced to imprisonment, the CP&C sentence is tolled and the defendant is removed from CP&C until the new sentence is completed, with reinstatement allowed unless otherwise ordered. Section 1 becomes effective Oct 1, 2026, while Section 2 takes effect immediately.
