HB93, known as Trey’s Law, would void nondisclosure provisions in agreements that silence reports of sexual abuse, making such terms unenforceable in Alabama beginning October 1, 2026.
If passed, the bill makes void and unenforceable any NDAs, confidentiality provisions, or similar clauses that prohibit disclosure of sexual abuse acts or related facts. It only applies to provisions that deal with disclosing sexual abuse, and only to agreements entered into, executed, or amended on or after October 1, 2026, and it does not affect other parts of an agreement, such as compensation. It also defines sexual abuse to include conduct that would be criminal under specific Alabama laws and offenses. The law aims to protect survivors' rights to speak and to keep their identities and experiences private when they choose.
