HB290 would create an Alabama state law requiring employers to provide a private location and reasonable break time for employees to express breast milk.
If enacted, the bill would require every employer to offer reasonable unpaid break time or allow use of paid breaks for expressing breast milk each day. Break time should, when possible, run concurrently with existing breaks. Employers must provide a private room or space near the work area (not a bathroom) for milk expression, and may not require building a dedicated room for this purpose; discrimination against employees who express milk would be prohibited. The act would take effect on October 1, 2026.
