SB70 expands Alabama's crime of transmitting obscene material to a child by computer to include transmissions to someone the sender believes is a child, with adult prosecution and non-expungement provisions, effective October 1, 2026.
The bill broadens the offense to cover sending obscene material via any computer system to a person the sender believes is a child, in addition to sending to an actual child. It continues to cover material depicting nudity, sexual conduct, or sadomasochistic acts for the purpose of initiating or engaging in sexual acts. It defines a 'child' as someone under 17 and sets that the crime can be committed in Alabama if the transmission originates or is received in the state. Anyone charged under this section would be tried as an adult, and the record would not be sealed or eligible for expungement; the offense remains a Class B felony.
