- Description
Under existing law, the Uniform Guardianship Act provides a system of general and limited guardianships for minors and incapacitated persons.
This bill would provide for the adoption of the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act which would provide an additional system to classify and address jurisdiction issues in adult guardianship cases where the guardian of an incapacitated adult is located in a different jurisdiction than the incapacitated adult. This bill would provide a procedure to facilitate cooperation between courts in different states. This bill would specify which court has jurisdiction to appoint a guardian or conservator. This bill would provide a procedure for transferring a guardianship or conservatorship proceeding from one state to another. This bill would also provide guidelines for enforcement of guardianship and protective orders from other states.
