Title
Child custody disputes, procedures for prevention of child abduction, credible risk for abduction factors, applicable to certain international abductions, emergency measures, Uniform Child Abduction Prevention Act
Description
<p class="bill_description"> Existing law provides for criminal
penalties where a child is abducted as the result
of a custody dispute. The bill would propose
adoption of the Uniform Child Abduction Prevention
Act</p><p class="bill_description">
This bill would clarify the procedures for a
parent or guardian and for a court to follow to
prevent a child abduction in a custody dispute
where there is a credible risk that an abduction
may occur</p><p class="bill_description"> This bill would establish a procedure by
which a parent or guardian could petition a court
to impose abduction prevention measures such as
travel restrictions and placing the name of the
child on the state department's child passport
issuance alert program</p><p class="bill_description">
This bill would provide for special measures
where there is a risk of international abduction</p><p class="bill_description">
This bill would provide factors to be
considered to determine whether there is a credible
risk that the child may be abducted</p><p class="bill_description">
This bill would authorize a court, where
abduction appears imminent, to direct law
enforcement to locate and take physical custody of
a child</p><p class="bill_entitled_an_act"> To adopt the Uniform Child Abduction Prevention Act;
to clarify procedures for a parent or guardian and for a court
to follow to prevent a child abduction; to provide that the
Uniform Child Custody Enforcement Act applies to cooperation
and communications under this act; to provide for
jurisdiction; to provide for the contents of a petition
seeking protection; to provide factors to be considered to
determine if there is a credible risk for abduction; to
provide for emergency measures; and to provide that the
uniform act shall be construed to promote uniformity between
states.
