Home Builders Licensure Board, residential home builders, proof of current licensure and liability insurance provided to homeowner before beginning construction
Description

This bill would require a residential home builder licensed by the Home Builders Licensure Board to provide proof of current licensure and liability insurance to a homeowner, or obtain a written waiver from a homeowner, before beginning construction on a structure, and would provide for board action against a licensee for violation

Relating to the Home Builders Licensure Board; to require residential home builders to provide proof of liability insurance to a homeowner before beginning construction on a structure; and to provide for action by the board for violations.

Relating to the Home Builders Licensure Board; to require residential home builders to provide proof of liability insurance to a homeowner before beginning construction on a structure; and to provide for action by the board for violations.

Section 1

Prior to the commencement of residential home building by a residential home builder, as defined in Section 34-14A-2, Code of Alabama 1975, the residential home builder shall disclose in writing to the homeowner whether the residential home builder has obtained and is currently maintaining liability insurance. The written disclosure shall be signed by the licensee and the homeowner, and attested by one witness selected by the homeowner. Failure of a residential home builder to comply with this section is a violation of Chapter 14A of Title 34, Code of Alabama 1975, and punishable by the board pursuant to Section 34-14A-8, Code of Alabama 1975.

Section 2

This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
