This bill would propose a local constitutional amendment relating to Jackson County to authorize the Cumberland Mountain Water and Fire Protection Authority to provide natural gas service in the county within the service area of the authority

This bill would propose a local constitutional amendment relating to Jackson County to authorize the Cumberland Mountain Water and Fire Protection Authority to provide natural gas service in the county within the service area of the authority

To propose an amendment to the Constitution of Alabama of 1901, relating to Jackson County, to authorize the Cumberland Mountain Water and Fire Protection Authority to provide natural gas service in the county within the service area of the authority.

Section 1

The following amendment to the Constitution of Alabama of 1901, is proposed and shall become valid as a part of the Constitution when all requirements of this act are fulfilled: PROPOSED AMENDMENT The Cumberland Mountain Water and Fire Protection Authority, in addition to other services provided in Jackson County, may provide natural gas services and operate a natural gas system in Jackson County within the service area of the authority. The authority and the board of directors of the authority shall have all powers and authority necessary to accomplish the purposes of this amendment, including the authority to amend the articles of incorporation of the authority to the extent necessary to accomplish the purposes of the amendment.

Section 2

An election upon the proposed amendment shall be held in accordance with Section 284.01 of the Constitution of Alabama of 1901, now appearing as Section 284.01 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.

Section 3

The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:

Relating to Jackson County; to propose an amendment to the Constitution of Alabama of 1901, to authorize Cumberland Mountain Water and Fire Protection Authority to provide natural gas service in the county within the service area of the authority.

Proposed by Act _________." This description shall be followed by the following language:

Yes ( ) No ( )."
