Description

Relating to DeKalb County; to amend Section 45-25-232 of the Code of Alabama 1975, as last amended by Act 91-456, 1991 Regular Session (Acts 1991, p. 828), which fixes the fee for issuance of a pistol permit in the county; to reduce that fee; and to provide for a further reduced fee for persons aged 62 or older or who are active duty first responders.

Relating to DeKalb County; to amend Section 45-25-232 of the Code of Alabama 1975, as last amended by Act 91-456, 1991 Regular Session (Acts 1991, p. 828), which fixes the fee for issuance of a pistol permit in the county; to reduce that fee; and to provide for a further reduced fee for persons aged 62 or older or who are active duty first responders.

Section 1

Section 45-25-232 of the Code of Alabama 1975, as last amended by Act 91-456, 1991 Regular Session (Acts 1991, p. 828), is amended to read as follows:

§45-25-232.

(a) In DeKalb County, the fee for issuance of a permit to carry a pistol concealed on or about the person or in a vehicle as provided by Section 13-11-75, shall be twenty-five dollars ($25) fifteen dollars ($15), which shall be collected by the sheriff of the county. Notwithstanding the foregoing, the fee for issuing the described pistol permit to a person aged 62 or older, or an active duty first responder, shall be one dollar ($1). For purposes of this article,

active duty first responder" includes state and local law enforcement officers, fire departments and voluntary fire department personnel, and emergency medical personnel who are actively employed or on active volunteer status to render or assist with emergency services.

(b) Any and all monies collected as provided above in subsection (a) shall be deposited in any bank within the county into a fund known as the sheriff's fund. The fund shall be drawn upon by the sheriff of the county, or his or her duly appointed agent, and shall be used exclusively for law enforcement purposes and in the discharge of the duties of the sheriff's office as the sheriff sees fit. The establishment of the sheriff's fund as provided in this section and the use of the funds shall in no way diminish or take the place of any other source of income established for the sheriff or for the operation of the office. All funds heretofore obtained from pistol permit fees and credited to any special fund or account in the county treasury under authority of any local or general law shall be returned to the sheriff of the county to be deposited and disbursed as provided above in this subsection."

Section 2

This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.
