Section 1
Section 16-43-5 of the Code of Alabama 1975, is amended to read as follows: "§16-43-5. "The State Board of Education shall afford pledge of allegiance to the United States flag shall be conducted at the beginning of each school day and all students attending public kindergarten, primary, and secondary schools shall be given the opportunity each school day to voluntarily recite the pledge of allegiance to the United States flag. A student who refuses to recite the pledge of allegiance may not be punished or penalized for that refusal.
Section 2
This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
