Bill Summary
Under existing law, certain individuals involved in the grand jury process are prohibited from disclosing certain information.
This bill would remove grand jury witnesses from certain provisions limiting disclosure of grand jury testimony.
Under existing law, grand jury proceedings are not required to be recorded.
This bill would provide that all grand jury proceedings must be recorded by a court reporter or stenographer.
This bill also would provide when a grand jury witness's testimony may be disclosed by the state and provides for the disclosure.
This bill would repeal the oath of secrecy for grand jury witnesses.
This bill would also make nonsubstantive, technical revisions to update the existing code language to current style.
Relating to grand juries; to amend Sections 12-16-214, 12-16-215, and 12-16-216, Code of Alabama 1975, to remove grand jury witnesses from certain provisions limiting disclosure of grand jury testimony; to add Section 12-16-213.1 to the Code of Alabama 1975, to require grand jury proceedings to be recorded by a court reporter or stenographer; to provide for when a testimony may be released by the state, and to provide for the procedure; to repeal Section 12-16-219, Code of Alabama 1975, relating to the oath of secrecy for grand jury witnesses; and to make nonsubstantive, technical revisions to update the existing code language to current style.
