State government, Office of Chief Procurement Officer, established, Division of Purchasing within the Dept. of Finance, abolished, Secs. 41-4-110 to 41-4-161, inclusive, 41-16-20 to 41-16-32, incl., 41-16-70 to 41-16-79, incl., repealed; Secs. 41-4-110 to 41-4-116, incl., 41-4-120 to 41-4-151, incl., 41-4-155, 41-4-160 to 41-4-168, incl., 41-4-170 to 41-4-178, incl., added; Sec. 41-4-66, 41-16-50 am'd.
Description
<p class="bill_description"> This bill would abolish the Division of Purchasing in the Department of Finance and replace it with the Office of the Chief Procurement Officer within the Department of Finance and would authorize the Chief Procurement Officer to make and supervise state purchases of supplies and services</p><p class="bill_description"> This bill would also provide for the appointment, qualifications, duties, and authority of the Chief Procurement Officer</p><p class="bill_entitled_an_act"> Relating to the purchase of supplies and services by state government; to repeal Article 2 (commencing with Section 41-16-20) of Chapter 16 of Title 41, Code of Alabama 1975, relating to competitive bidding on public contracts generally; to repeal Article 3A (commencing with Section 41-16-70) of Chapter 16 of Title 41, Code of Alabama 1975, relating to competitive bidding on contracts for goods and services; to repeal Division 1 (commencing with Section 41-4-110) of Article 5 of Chapter 4 of Title 41, Code of Alabama 1975, relating to the Division of Purchasing in the Department of Finance; to replace the repealed Division 1 and the previously repealed Division 2 (commencing with Section 41-4-130, and repealed by Act 2009-763, 2009 Regular Session) of Article of Chapter 4 of Title 41, Code of Alabama 1975, with a new Article 5 (commencing with Section 41-4-110), to create the Office of the Chief Procurement Officer in the Department of Finance and the position of Chief Procurement Officer; to authorize the Chief Procurement Officer to make or supervise the purchase of supplies or services by the state; to provide for the appointment, qualifications, duties, and authority of the Chief Procurement Officer; and to amend Sections 41-4-66 and 41-16-50, Code of Alabama 1975, to provide the Chief Procurement Officer with the authority to maintain the state database of each request for proposal for a public contract and to delete state trade schools, junior colleges, colleges, and universities under the supervision and control of the Alabama Community College System from coverage under the public bid law in Article 3 of Chapter 16 of Title 40, Code of Alabama 1975. </p>
