Title
Firearms, sentencing requirements established, certain offenders excluded from being eligible for certain correctional programs, Sec. 13A-11-72.2 added.
Description
<p class="bill_description"> Under existing law, a person convicted of
certain offenses is prohibited from owning a
firearm</p><p class="bill_description">
This bill would provide for additional
offenses that would prohibit a convicted person
from owning or possessing a firearm or ammunition</p><p class="bill_description">
This bill would provide various penalties
for unlawful ownership of certain firearms</p><p class="bill_description">
This bill would also establish certain
sentencing requirements for firearm-related
offenders and would exclude any convicted
firearm-related offender from eligibility for
certain correctional programs under certain
conditions</p><p class="bill_description">
Amendment 621 of the Constitution of Alabama
of 1901, as amended by Amendment 890, now appearing
as Section 111.05 of the Official Recompilation of
the Constitution of Alabama of 1901, as amended,
prohibits a general law whose purpose or effect
would be to require a new or increased expenditure
of local funds from becoming effective with regard
to a local governmental entity without enactment by
a 2/3 vote unless: it comes within one of a number
of specified exceptions; it is approved by the
affected entity; or the Legislature appropriates
funds, or provides a local source of revenue, to
the entity for the purpose</p><p class="bill_description">
The purpose or effect of this bill would be
to require a new or increased expenditure of local
funds within the meaning of the amendment. However,
the bill does not require approval of a local
governmental entity or enactment by a 2/3 vote to
become effective because it comes within one of the
specified exceptions contained in the amendment</p><p class="bill_entitled_an_act"> Relating to firearms; to amend Sections 13A-11-70,
13A-11-72 and 13A-11-84 of the Code of Alabama 1975; to add
13A-11-72.1 to the Code of Alabama 1975; to prohibit certain
persons from owning a firearm; to exclude certain individuals
from correctional programs under certain conditions; to
establish certain sentencing requirements for certain
offenders and exclude those offenders from certain
correctional programs under certain conditions; to further
provide for penalties; and in connection therewith would have
as its purpose or effect the requirement of a new or increased
expenditure of local funds within the meaning of Amendment 621
of the Constitution of Alabama of 1901, as amended by
Amendment 890, now appearing as Section 111.05 of the Official
Recompilation of the Constitution of Alabama of 1901, as
amended.
