HB6 recognizes parental rights to direct the upbringing of their children as fundamental and restricts government action that would burden those rights unless narrowly tailored to a compelling state interest.
It codifies that parents have a fundamental right to direct their children's education, upbringing, care, and control. The government may burden this right only if the burden is narrowly tailored to a compelling state interest and uses the least restrictive means. It does not authorize abuse or neglect and applies only to disputes involving parents and the government or third parties (not disputes between parents). It becomes effective on the first day of the third month after it is passed and approved by the Governor.
