HB328 lets Shelby County void licenses if a payment for a license is found non-collectible and adds a reimbursement plan for certain losses to the license department.
If a payment for a motor vehicle or other Shelby County license is deemed non-collectible, the License Department must make a reasonable effort to retrieve the license and the Shelby County Manager may void the license and related taxes and fees. The County Commission will reimburse the License Department from the General Fund for losses due to errors or omissions, up to $3,000 per year (or another amount the commission allows). The law requires the License Department employees to exercise due care, quickly correct errors, and seek to collect the amount when possible, while not covering deliberate misuse. The act applies only in Shelby County and becomes effective June 1, 2024.
