HB460 would bar certain Alabama state agencies and sunset-law entities from owning real property starting June 1, 2024, with limited grandfathering and exemptions, and create dedicated funds to manage property-related needs for some boards.
It prohibits listed agencies from purchasing or holding title to real property beginning June 1, 2024, with exceptions for property already in the closing process or completed. It allows grandfathering for real property previously purchased or acquired by an agency. It repeals future authority to acquire real property for the Alabama Surface Mining Reclamation Commission, Bear Creek Development Authority, Alabama Board of Funeral Services, Home Builders Licensure Board, Alabama State Board of Pharmacy, State Board of Chiropractic Examiners, State Board of Medical Examiners, and the Alabama Construction Recruitment Institute. It creates the Funeral Board Property Acquisition Fund and the Home Builders Property Acquisition Fund, funded by license fees (up to $60 per license per year, inactive licenses exempt) and annual transfers of 2-7% of receipts, with carryover of unspent funds and a prohibition on new acquisitions after June 1, 2024 for certain boards.
