HB92 tightens asbestos exposure lawsuits in Alabama by requiring detailed disclosures, trust-claim filing, and procedural safeguards that can lead to dismissal or discovery delays if not followed.
If enacted, plaintiffs must file an affidavit within 45 days of filing an asbestos action that lists the basis for every claim against each defendant and includes extensive details about the exposed person, exposure sources, worksites, dates, and knowledgeable individuals. Plaintiffs must also file all available asbestos trust claims and related materials within a set timeframe and continue to supplement as new information or additional trust claims become available. Defendants may move to require supplementation if disclosures are incomplete, the court can stay discovery until disclosures are provided, and the court can dismiss claims without prejudice if the plaintiff fails to comply.
