This bill shields county commissions from certain lawsuits over how public funds are spent when a local law lets a single official decide how those funds are used.
It states that a county commission shall not be liable or a party to a suit challenging the expenditure or use of public funds when a local law provides that the funds be expended, awarded, or used at the discretion of a single public official. In such cases, no damages or litigation costs may be recovered from funds under the county commission's control. The bill applies to expenditures, awards, or uses described under that local law. It becomes effective October 1, 2024.
